Welcome to Cass Danson (referred to as "we," "us," or "our"). By visiting our website and/or purchasing from us, you engage in our "Service" and agree to be bound by the following Terms of Service ("Terms"), including those additional terms, conditions, and policies referenced herein or available by hyperlink.

Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms.

1. Online Store Terms & General Conditions

  • By agreeing to these Terms, you represent that you are at least the age of majority in your state or country of residence.

  • You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including but not limited to copyright laws).

  • We reserve the right to refuse service to anyone for any reason at any time.

  • You understand that your content (not including credit card information) may be transferred unencrypted over various networks. Credit card information is always encrypted during transfer over networks.

2. Products, Orders & Made-to-Order Items

  • Made-to-Order Decals: Our wall decals are custom-printed to order. Because of this, orders cannot be cancelled, modified, or refunded for change of mind once processing begins (after a 24-hour grace period for international orders).

  • Apparel & Sizing: You are responsible for ensuring correct sizing prior to purchasing apparel. Please consult our sizing guides.

  • Product Colors & Accuracy: We make every effort to display the colours and images of our products as accurately as possible. However, we cannot guarantee that your computer or device screen's display of any colour will be 100% accurate.

  • Price Changes & Availability: Prices for our products are subject to change without notice. We reserve the right to modify or discontinue any product at any time without notice.

3. Shipping, Import Duties & Taxes

  • Production, processing, and shipping timeframes are estimates and are detailed in our Shipping Policy.

  • We ship directly from Australia via Australia Post to Australia, New Zealand, and the United Kingdom.

  • International Taxes & Duties: For customers in New Zealand and the United Kingdom, your order may be subject to local import duties, VAT, or customs clearance fees upon arrival. All taxes, duties, and customs fees are the sole responsibility of the customer. We are not responsible for delays caused by local customs agencies.

4. Returns, Exchanges & Australian Consumer Law

  • Your purchases are backed by the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts, or modifies any legal rights or guarantees you have under the ACL.

  • Faulty or Damaged Goods: If a product arrives damaged or with a manufacturing fault, please notify us immediately at info@cassdanson.com with photos of the issue. If confirmed, we will provide a repair, replacement, or refund in accordance with your statutory rights.

  • Change of Mind & Exchanges: Change of mind returns are not accepted for custom-printed wall decals. Apparel exchanges and store credit are governed strictly by our Shipping & Returns Policy (must be requested within 14 days of receipt, in original condition with tags and original packaging, free from scents and pet hair, with return shipping covered by the customer).

5. Intellectual Property

  • All content on this website—including but not limited to wall decal designs, artwork, graphics, text, logos, product photos, and branding—is the exclusive property of Cass Danson and is protected by Australian and international copyright and intellectual property laws.

  • You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of our designs, products, or website content without express written permission from us.

6. User Comments, Feedback & Submissions

If you send us creative ideas, reviews, photos, suggestions, or other materials (whether online, by email, or otherwise), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, and otherwise use any comments or images that you forward to us (e.g., customer photos shared for marketing or review purposes).

7. Errors, Inaccuracies & Omissions

Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the site is inaccurate at any time without prior notice (including after you have submitted your order).

8. Limitation of Liability

To the maximum extent permitted by law, Cass Danson shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, arising from your use of any of our products or our service.

Our wall decals should be applied in accordance with provided guidelines. We are not responsible for damage to walls, paint, or surfaces caused by improper application, incorrect surface preparation, or pre-existing wall conditions.

9. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Australia (State of Victoria / Commonwealth of Australia).
